Abstract
This academic article makes a proposal about the important role that the dogmatic category of punishability and the elements that compose it should have; As a starting point, the author addresses the diverse positions of the Hispanic doctrine on the issue. This, is fair to say, allow to emphasize the usefulness of this elaboration, which understands, it is an essential component of the judgment of responsibility. At the same time, it´s argues that the category of punishability is structured around three utility values that characterize the responsibility judgment: effectiveness and efficiency.
