Abstract
The purpose of this article is to highlight that pretrial detention has precautionary and non-punitive objectives; Therefore, it should not be imposed for purposes other than those. Even more when the legitimate purposes have been determined in the standards of the Inter-American Human Rights System, according to which it seeks to ensure the appearance of the accused at trial and prevent the obstruction of the criminal procedure. Thus, it stands out as a reparation to the risk of affecting the community that the measure of preventive detention argued, in pursuit of this purpose, does not aim at procedural assurance
but, in reality, constitutes an anticipation of the penalty.
