Abstract
There is no coincidence between the criminal offenses contained in Articles 188A and 188B of the Criminal Code and those provided for in Article 93 of Law 1453 of 2011; The expression "begging with minors", contained in the latter legal provision, is conditionally constitutional as long as it is understood that it "exclusively criminalizes the use of minors for the exercise of begging and not the autonomous exercise of begging in the company of minors", the latter behavior, according to the jurisprudence, cannot be punished in a State governed by the rule of law.
