Cano Jaramillo, Carlos Arturo. Accusatory criminal procedure, orality, debate and argumentation.

Abstract

The text of this review reflects on the concept of orality and the set of communicative skills or competencies that must be met for an adequate performance in the different hearings within the adversarial criminal regime, in harmony with the rules of the Code of Procedure on the matter. The author recalls that we are facing a change in which the interventions in the different hearings require ample listening skills and mastery of the spoken and persuasive word, a dynamic for which - in a culture that came from an inquisitorial scriptural system - time, resources and training are required. For this necessary, and sometimes neglected, training, the text under review is very important, not only for lawyers who practice law in different roles, but also for those who, from other disciplines, participate in the debate for a professional performance with solvency.
