Principle of equality and immunity from criminal prosecution

Abstract

This contribution briefly analyzes, in the light of the scientific bases of some European regulations, and in particular the Spanish one, the thorny issue of the privileges of senior officials, authorities and public officials in the field of criminal proceedings, and more specifically seeks to specify to what extent such special protection may affect the principle of equality, and, going further, whether such an exception to it should be justified and protected by a democratic constitution.
