Abstract

Beyond the difficulties inherent in its denomination and the field it is intended to demarcate, it is an undeniable fact that the irruption of the so-called 'economic criminal law' in the criminal law scenario has had important consequences: The design of a criminal policy designed to 'confront' a crime of an economic nature with global reach involving corporations, the 'adaptation' of the general part (of the theory of crime and also, of course, of punishment), the redefinition of some 'traditional crimes' and the creation of a significant number of 'new crimes' under the protection of a legislative technique that confronts the classic principles or, finally, the adjustments in investigation techniques and procedural and evidentiary regimes, illustrate this clearly.
