Abstract

The text studies the rules concerning market abuse in the European Union, the application of financial market regulation and market manipulation. Also, based on the analysis of two cases, it shows how in the framework of the current regulation the national authorities in the EU are not at all aware of the dimension of their tasks in Europe. He analyzes recent legislative proposals aimed at creating a level playing field for economic operators, citizens and law enforcement authorities. He also draws a distinction between the measures proposed in the field of administrative law and criminal law, to argue that these proposals do not yet take into account the central objectives of the EU.
