Abstract

The carrying of narcotics, not only in the case of "slight excesses of the dose for personal use", but also in "quantities greater than those established by the legislator as personal dose", is not an unlawful conduct if it is proven that the agent "undoubtedly sought to satisfy his own need for consumption and not for trafficking purposes", since such behavior "does not have the potential to affect the legal interests of others (health, public safety or the economic and social order)".
