Abstract
The text contains an important reflection on the autonomy of the Judiciary, taking Colombia and Spain as reference frameworks; it is noted that, although there is a certain independence of the judicial sector, it has been subdued and overcome by the political power, which leads the author to question whether this task is a myth or a reality. In this way, it seeks to identify the guarantees on which judicial systems should be built, in order to achieve a real separation between politics and justice, with emphasis on a clear division of powers.
