Abstract
There is a prison and penitentiary crisis in Colombia due to the overcrowding rate that has reached 58%, which has generated a clear violation of the rights and guarantees of inmates. It has been a massive and permanent violation, to the point that the Constitutional Court has declared the state of affairs unconstitutional on several occasions. Among the consequences found is the affectation of resocialization processes, which in turn leads to high rates of criminal recidivism. A detailed study is made of the figures, the legislative reforms in criminal matters that have had a negative impact, and the terrible conditions of the detention centers. The problem raised deserves an urgent intervention of the State to protect the rights of the people who are in prisons and penitentiary establishments of the national territory, and this investigation showed that the resocialization processes are not being carried out adequately since there is little infrastructure. , there is no endowment of the supplies and personnel necessary to carry out work, study or teaching activities.
