Abstract

In the Colombian legal system for public administration, discretion is fundamental and with it the function of the state is materialized, the activity is legitimated, it realizes the deviation and the abuse of power, therefore, it is necessary to address the thematic from the discourse of the phenomena of legal and political theory. In this way the present scientific document has an object, from the judicial and legal hermeneutics, performs a detailed analysis of the factors, the consequences and the antecedents from the public administration, the administrative jurisprudence and the matter in the matter of controversies and conflicts generated by The discretion of the withdrawal in the administrative career of the military forces.
