Abstract

Our understanding about equal rights for all is based on fundamental rights, democracy and the separation of powers, which are uniformly understood in Europe, which allows for similar rules throughout the continent and requires subsidiarity. In criminal law, clear terminology is also essential in the application of the law and in the dialogue between democracy and the rule of law.
