Abstract

The concept of forced disappearance, first established in Law 589 of 2000, can be applied retroactively to events that took place on November 6 and 7, 1985, given that at that time the conduct was defined as kidnapping; these types of crimes are crimes against humanity and, therefore, are not subject to any statute of limitations. The convicted person acted as the real perpetrator-by-means through an organized criminal apparatus of power.
