The breach in the division of powers: ineffectiveness as justification

Abstract

A clear example is the control of constitutionality that the judicial branch carries out on laws passed by Congress, which represents the legislative branch. Likewise, there is the motion of censure, which is sometimes promoted by the Congress against ministers, that is, a political control carried out by representatives of the legislative branch to others who are part of the executive branch. This is how a type of mutual control of the branches of power permitted by the constitution and the laws is created without this constituting a breach in the division of powers, in the political system or in the legal system.
